COMMENTS:
The Local Highway Authority (LHA) would not wish to raise any objections in principle to the erection of five in number family size detached dwellings, served by a private Shared Surface access road, with private car parking, and access from Arcadia Road.
The planning history for the development is set out in Section 2.4 of the application Design Statement (DS). In brief, the previous planning application for the development of five dwellings under application 22/00784/FUL, was refused by the Local Planning Authority (LPA). The subsequent planning appeal was dismissed by the Planning Inspector, up-holding in-part some of the LPA's refusal reasons.
In respect of the transport and highway impacts, the Planning Inspector found the overall design of the Shared Surface Street to be adequate to serve the five dwellings, but the Turning Head unsuitable to properly accommodate refuse collection vehicles due to being under size. Giving concerns over sideways conflict with other users of the access road, prejudicing safety, and with potential conflict with the built form and landscaping, including biodiversity. In which regard the Inspector also referred to, conflict with Chapters 9 and 12 of the Framework where safe, suitable and inclusive access which promotes sustainable modes for all users, into well-functioning developments is required.
The current revised details, including in both the DS and the transport Addendum Technical Note (ATN) and their appendices, show how the concerns raised by the Planning Inspector over sideways conflict in the Turning Head have been addressed. The revised plan drawings, including the 'Proposed Site Plan 168-0030-Rev H' (revised 05/01/2024), indicates how the Turning Head has been altered to properly and safely accommodate a refuse lorry. Altered by setting-back the west corner of the Turning Head from the carriageway alignment by approximately 1 metre, and by widening the 't' spur to approximately 7 metres wide with clearance margins either side. (incidentally, with the alterations to the layout compensating for the undersize 3 metre radii of the Turning Head). Whilst the Vehicle Tracking plan (in the DS and the ATN) titled and numbered 'Swept Path Analysis Plan- C20093-SPA003-REV E', shows how the revised Turning Head arrangement would properly accommodate the turning of a refuse lorry.
The new access road has been designed, considered, and intended as a Shared Surface Street with clearance margins either side, where the road carriageway surfacing material has to be distinctly different form an average road and is usually Block Paved. As indicated on the drawing, 'Site Plan In Context, numbered - 168-004 REV D', that shows a different finish and contrast between the black-top surfacing in the Bellmouth at the entrance, and the remainder of the Shared Surface Block Paved road carriageway. The Block Paved road carriageway is also shown and notated on the drawing in the ATN appendix, titled and Numbered ' 'Proposed Site Access Point General Arrangement Design - C20093-TP001-REV F', that states 'Shared surfacing to continue throughout the internal layout'. Therefore, the proposed Shared Surface street should be Block Paved in a contrasting colour and constructed and laid in accordance with current best practice guidance issued by 'Interpave' for laying Block Paved Shared Surface Streets.
The satisfactory function of the surface water drainage serving the new access road would be reliant on the Lead Local Flood Authority approval of the overall design for the disposal of surface water.
Off-street car parking should be provided in accordance with the approved plans.
Electric Vehicle Charging Points should be provided at a ratio of one charging point per dwelling in accordance with the advice provided within Section 8 of the Councils Supplementary Planning Document (SPD), and national guidance.
Forward and inter-visibility shall be maintained as shown on the drawing titled and numbered 'Proposed Site Access Point General Arrangement Design- C20093-TP001-REV F'.
SUMMARY:
The Local Highway Authority (LHA) would not wish to raise any objections in principle to the erection of five in number family size detached dwellings, served by a private shared surface access road with private car parking and access from Arcadia Road subject to the following recommended conditions: -
COMPLETION OF ROADS AND FOOTWAYS
() All roads and footways forming part of the development hereby permitted shall be completed in accordance with the approved drawings including the drawing titled and numbered ' 'Proposed Site Access Point General Arrangement Design- C20093-TP001-REV F', that shows Block Paved surfacing and notates 'Shared surfacing to continue throughout the internal layout'. The Block Paving shall be of a contrasting colour and constructed and laid in accordance with current best practice guidance issued by 'Interpave' for the laying of Block Paved Shared Surface Streets. No dwelling shall be occupied until that part of the service road which provides access to it has been constructed in accordance with the approved details.
Reason:
To ensure that an appropriate and safe access is provided in accordance with Policy DEV29 of the adopted Plymouth & Southwest Devon Joint Local Plan 2014 - 2034
PRESERVATION OF SIGHT LINES
() No structure, erection or other obstruction exceeding 600mm in height shall be placed, and no vegetation shall be allowed to grow above that height within the approved sight lines to the site access at any time.
Reason:
To preserve adequate visibility for drivers of vehicles at the road junction in the interests of public safety in accordance with Policy DEV29 of the adopted Plymouth & Southwest Devon Joint Local Plan 2014 - 2034.
PROVISION OF PARKING AREA
() Each parking space shown on the approved plans shall be constructed, drained, surfaced and made available for use before the unit of accommodation that it serves is first occupied and thereafter that space shall not be used for any purpose other than the parking of vehicles.
Reason:
To enable vehicles used by occupiers or visitors to be parked off the public highway so as to avoid damage to amenity and interference with the free flow of traffic on the highway in accordance with Policy DEV29 of the adopted Plymouth & Southwest Devon Joint Local Plan 2014 - 2034.
PROVISION OF ELECTRIC VEHICLE CHARGING POINTS
() To assist lower carbon emissions electric car charging points are required to be provided at a ratio of one charging point per dwelling in accordance with the details set-out as a minimum requirement in par 8.39 & Table 33 of the Councils Supplementary Planning Document and in accordance with the national guidance available on-line: - https://www.gov.uk/government/publications/electric-vehicle-homecharge-.
Reason
To assist in the lowering the carbon footprint of the development in accordance with Policy DEV29 of the adopted Plymouth & Southwest Devon Joint Local Plan 2014 - 2034.
INFORMATIVE ' PRIVATE ROAD DRAINAGE
The satisfactory function of the surface water drainage serving the new private access road would be reliant on the Lead Local Flood Authority approval of the overall drainage design for the disposal of surface water.

The new cul-de-sac Shared Surface Street is designed and intended as a private street that would be maintained by a Management Company.
