Condition 3 ' Street Details:
The Local Highway Authority (LHA) provided some preliminary comments with regard to the adoption of the site via S38 Agreement as part of the consultation response for the original planning consent. It is unfortunate that the applicant has not made the amendments requested (largely relating to suitable adoptable footway provision and increased radii at junctions) as this would now limit the extent of the areas eligible for adoption.

Furthermore, the provision of only a 0.5m margin in place of a 2m adoptable footway on the southern side of the main spine road could preclude the site for adoption. As the applicant has now paid the required deposit fee for the separate S38 application, full technical comments will be provided in respect of adoption via this process.

With regard to the Street Details condition, the LHA are unable to recommend discharge at this time.

There are inconsistencies in the submitted drawings (S38 Adoption Plan, Surfacing Specification drawings and Proposed Site Plan), including differences between the proposed surfacing of footways and the absence of service margins in certain areas of the site. The drawings should be updated to ensure that the details are consistent across all plans.

As stated within the condition, details relating to the 1.8m high boundary walls adjacent to parking spaces are required. It was requested that these walls were either reduced in height or splayed to provide suitable levels of inter-visibility, yet no amendments have been made to satisfy this requirement.

In addition, further details relating to retaining walls adjacent to the existing public highway and highway intended for adoption were required. The Structures team have been consulted and additional information by way of section drawings which show the wall construction will be required for the retaining walls located in the following locations:

- Along northern boundaries of Plots 110 and 94 adjacent to the existing
HMPE on Clittaford Road
- On the southern side of Road 6 along the northern boundary of Plot 32
- On the western side of Road 5 along the eastern boundary of Plot 20

Furthermore, there are multiple junctions within the estate that have insufficient radii in the order of 3m when a 6m radii is required. The submitted tracking plans show vehicle override of the footway adjacent to plots 51, 20 and 35 which would give rise to concerns of highway safety and therefore, this would need to be addressed.

Some form of boundary treatment will be required adjacent to the parking spaces labelled 31 and 32 to protect the pedestrian link through to Southway Drive from vehicle override.

No details surrounding the street lighting proposed as part of the development have been submitted in support of the discharge of this condition. Such details will be required for review.

Condition 4 ' Construction Traffic Management Plan (CTMP)
The submitted Construction Traffic Management Plan (CTMP) is considered acceptable and therefore the LHA can recommend this condition for discharge. The development shall be constructed in accordance with the approved document.

Condition 5 ' Highway Dilapidation Survey
Network Management have been consulted over the submitted Highway Dilapidation Survey and whilst the extent is accepted, some of the images do not clearly display the existing defects. Therefore, Network Management have requested that a brief description of the defect detailed within each image is provided. Until such a time that the survey has been updated to include this detail, the LHA are unable to recommend the discharge of this condition.

Recommendations:
The submitted CTMP is accepted and therefore, the LHA can recommend the discharge of condition 4.

The submitted Highway Dilapidation Survey will need to be updated in accordance with the above comments before the LHA can recommend condition 5 for discharge.

Further information relating to the 1.8m high boundary walls, retaining walls and street lighting design, and amendments to provide a street layout which is fit for purpose in accordance with best practise design standards will be required before the LHA can recommend condition 3 for discharge.

The proposed development has been considered in accordance with the Councils current Development Plan Policies and having regard for the National Planning Policy Framework.
