Highway Authority Consultation Reply

APPLICATION NO: 22/00667/FUL

SITE: 200 Pike Road, Plymouth, PL3 6HJ

DEVELOPMENT: Porch and driveway (Part-Retrospective)


Observations:

I refer to your consultation dated 22nd April 2022 regarding the above planning application for the construction of a porch and parking area at the above property.

A considerable amount of works have already been carried out, including works within the Highway, hence the part-retrospective nature of this application.

I have visited the site and have no objections to the proposal in principle but the works to date have not received the necessary approvals or licenses from the Highway Authority (Network Management Team), nor do they meet the required standards.

The applicant has been informed that a licence must be obtained and that any works within the highway, which includes the verge at the rear of the footway, must be completed by an approved streetworks accredited contractor, and only once an application has been made and granted by the Network Management Team.

The principle of the parking area is accepted and the applicant must ensure that no private surface water or loose material is permitted to flow or deposit on to the highway.

In order to gain access to the parking area a footway crossing must be constructed in accordance with the requirements of the Highway Authority. Such an access will only be granted where it is 6m or more from any existing crossover and also 1m from the street tree.

As works have been carried out unlawfully the applicant must make-good the areas of footway and verge outside of the permitted extent of crossing. The verge must be re-instated.

The applicant has been advised to consider future connection to power for an electric vehicle, whilst works are yet to be completed. This advice is offered in good faith only and it is not considered necessary to request this via a condition. The applicant may wish to consider passive wiring or ducting to safeguard a future connection though.

No further works in the highway should take place until such time that an application has been made to the Highway Authority for the license to work within the highway and any permitted works must be completed to an agreed standard, in accordance with the license.

Although works have been carried out unlawfully within the highway the principle of the development is acceptable and subject to further approvals can be completed in an appropriate manner. Therefore, there are no objections to the proposal.

Recommendation:

The Highway Authority recommends that the following condition is attached to the granting of planning permission.

TN27 - SURFACING OF DRIVEWAY/PARKING AREAS - Amended
Before the development hereby permitted is used, the driveway / parking area shall either be (a) constructed using a permeable construction or (b) hard paved and drained to a private soakaway; and shall thereafter be maintained to ensure satisfactory access to the adjoining highway, in accordance with details to be submitted to and approved in writing by the Local Planning Authority.

Reason:
To ensure that no private surface water or loose material is deposited onto the adjoining highway in the interests of highway safety in accordance with Policy DEV29 of the Plymouth and South West Devon Joint Local Plan, Adopted March 2019.

Before the access[es] hereby approved are first brought into use it will be necessary to secure dropped kerbs [and footway crossings] with the consent of the Local Highway Authority. The applicant should contact Plymouth Highways for the necessary approval. Precise details of all works within the public highway must be agreed with the Highway Authority.

This planning permission does not authorise the applicant to carry out works within the publicly maintained highway. The applicant should contact Plymouth Highways for the necessary approval. Precise details of all works within the public highway must be agreed with the Highway Authority and an appropriate Permit must be obtained before works commence.
