Further to my previous highway consultation response, the applicant has now submitted a revised CEMP which has addressed concerns relating to loading/unloading provision and the parking of contractors vehicles. Therefore I am now content that Condition 4 (CEMP) can now be discharged.Natural Infrastructure Team

Condition 9 ' LEMPSections of neutral grassland are integral to this site achieving a biodiversity net gain. The method for establishing neutral grassland is a complicated and in depth undertaking. The method provided in the LEMP (section 4.2.3) for the establishment of neutral grassland is inadequate and therefore based on the provided information we do not believe that the creation and subsequent 30 year maintenance of neutral grassland is currently achievable.
In order to progress with the discharge of this condition we will need to see a detailed neutral grassland establishment plan based on detailed soil analysis. We will need details of the seed mix to be used and how the suitability of this has been matched to the soil conditions and fertility on site. We will also need a full, scientifically robust, detailed maintenance plan demonstrating how, once established, the neutral grassland will be retained for the required 30 year period.
Condition 4 ' CEMP
The CEMP provided is currently inadequate. In order to discharge this condition we will need to see:
' Details of method statements as requested in section C of the condition
' Locations and timings of sensitive works as requested in section D
' Details of the times that specialist ecological contractors will be on site during the construction as requested in section E
' Details of the roles and responsibilities of the ECoW as requested in section G.
Condition 8 - Bird Nest Boxes
Condition 8 (nest boxes) states that 2 integral bird boxes should be installed on 3 sides of the building. While we will accept that the bird boxes are not integral on this occasion, the drawings supplied to discharge this condition show 1 bird box on 2 sides of the building and so this is not sufficient to discharge.

With regard to discharge of Condition 3 (Highway Dilapidation Survey), I have now received confirmation from colleagues in Network Management that the survey is acceptable and consequently this condition can now be discharged.Comment Date: Thu 20 Oct 2022
Having reviewed the information submitted for the discharge of highway-related conditions, I would wish to comment as follows:Condition 4 (CEMP)
Whilst I have no in-principle objections to the CEMP that has been produced, there is very little information in respect of arrangements for deliveries and where such vehicles would park whilst being loaded/unloaded. Sufficient provision should be made for such in order to avoid disruption to traffic movements on the local road network. In addition the LHA would also want to receive some assurances that adequate provision will be made within the site for the parking of contractor's vehicles in order to prevent such parking from taking place on the local roads serving the existing businesses within the immediate area.
Condition 6 (Details of New Junction)
I note from the plan provided that the vehicular access is to be constructed as a footway crossover and therefore dropped kerbs and tactile paving on either side of the access will not be necessary as priority is given to the pedestrian movement.
The specification for vehicular crossovers outlined in the Devon Design Guide refers to the requirement that'.'Where it is likely that vehicular crossings will be used by commercial vehicles of over 1.5 tonnes unladen weight, the crossing shall be constructed to the same specification as the carriageway'.
In view of the above-mentioned comment (and the possibility that the site may generate regular deliveries by vehicles heavier than 1.5t), it is recommended that the thickness of the Surface Course be increased to 40mm of 10mm SMA. The Binder Course and Sub Base can remain the same. The extent of any tie-in surfacing works will need to be agreed with PCC's Inspector over-seeing these works on behalf of the LHA under the provision of the Section 184 Licence.
On the basis of this change being made I will then be in a position to recommend the discharge of this condition.
Condition 7 (Car Parking Management Strategy)
I have no issues with the content of the CPMS and am content that the condition associated with such can be discharged.
