COMMENTS:
The Local Highway Authority (LHA) would support in principal the proposed phasing arrangements for the development, and would largely support the proposed associated Section 73 variations of the referred transport and highway related planning conditions, of previous application 21/01557/FUL; including in consideration of the proposed variation to Planning Condition 8.
Planning Condition 8 also related to phasing and required a 'Programme of Works' to be submitted and approved 'prior to commencement of the development'. To include specifying the timings of delivery/implementation of details secured through Planning Conditions: -
10: Installation of Bird Boxes - 17: Car Parking Provision - 18: Cycle Provision - 19: Biodiversity and Landscaping Works & 20: Electrical Vehicle Charging Points, with only Conditions 17, 18 & 20 being Transport related conditions. Along with Planning Condition 15 that requires the Provision of Sight Lines, and Condition 24 that reserves the Service Area for servicing only.
The application details includes a 'Condition Variation Request Sheet' (Dated 17.02.23), which indicates the proposed amendments to the various Planning Conditions in red text. To which the LHA would not largely object apart from one exception, that being (previous) Condition 18 Cycle Parking Provision, which does not seem to be notated on the named revised drawing 'Site Plan 008 REV A'. In view of which the LHA advises that a standard Planning Condition to secure Cycle Parking is included in any grant of planning permission, along with a re-applied and amended Condition to secure car parking.
SUMMARY:
The LHA would not wish to raise any objections in principal to planning permission being granted in accordance with the above comments, and recommends the following Planning Conditions are included in any consent:-
CONDITION: SIGHT LINES PRE-OCCUPATION (Previous Condition 15 amended)
() The Sight Lines hereby approved as indicated on the application drawing 'Proposed Site Plan 008 REV A ', and in Figure 9 of the Transport Statement shall be provided at the two junctions between the means of access and the highway before the associated phase of the development is brought into use, and shall thereafter be maintained.
Reason:
To provide adequate visibility for drivers of vehicles at the road junction in the interests of public safety in accordance with Policy DEV29 of the adopted Plymouth & Southwest Devon Joint Local Plan 2014 - 2034
TN22 - CYCLE PROVISION
() The building shall not be occupied until space has been laid out within the site in accordance with details previously submitted to and approved in writing by the Local Planning Authority for eight (8) in number bicycles to be securely parked, in accordance with the requirements and provisions contained in paragraphs 8.33 - 8.37 of the Councils Supplementary Planning Document for cycling provisions.
Reason:
In order to promote cycling as an alternative to the use of private cars in accordance with Policy DEV29 of the adopted Plymouth & Southwest Devon Joint Local Plan 2014 - 2034.
CAR PARKING PROVISION (amended)
() The building shall not be occupied until the respective car parking area for the associated phase of the development shown on the approved plans has been drained and surfaced and made available for use in accordance with the phasing of the approved details. To provide on completion an overall total of 53 car parking spaces that shall not thereafter be used for any purpose other than the parking of cars.
Reason: To enable vehicles used by occupiers or visitors to be parked off the public highway so as to avoid damage to amenity and interference with the free flow of traffic on the highway in accordance with Policy DEV29 of the adopted Plymouth & Southwest Devon Joint Local Plan 2014 - 2034.
ELECTRIC VEHICLE CHARGING POINTS (Previous Condition 20 amended)
() Unless otherwise agreed in writing, a minimum of thirteen electric car charging points along with passive wiring shall be provided in accordance with the submitted details shown on approved plans 'Proposed Basement Plan Appendix 002 REV A & 'Proposed Ground Floor Plan Appendix 003 REV A, which shall be brought forward in accordance with the agreed timeframe as required by Condition 8 of this consent.
Reason
To assist in the lowering the carbon footprint of the development in accordance with Policy DEV29 of the adopted Plymouth & Southwest Devon Joint Local Plan 2014 - 2034.
USE OF SERVICE AREA (Previous Condition 24 amended)
() Unless otherwise agreed in writing, the principle servicing area to the north of the Phase 1 North Building, as identified on the Proposed Site Plan 008 Rev A, shall be made available for servicing use in perpetuity; including the loading and unloading of vehicles: unless an alternative and equivalent area of land within the curtilage of the site is provided with the prior consent in writing of the Local Planning Authority.
Reason:
To ensure that space is available at all times to enable such vehicles to be loaded and unloaded off the public highway so as to avoid: - (i) damage to amenity; (ii) prejudice to public safety and convenience, and (iii) interference with the free flow of traffic on the highway; in accordance with Policy DEV29 of the adopted Plymouth & Southwest Devon Joint Local Plan 2014 ' 2034
