DEVELOPMENT: Removal of Condition 9 (Ancillary of Incidental Use) of application 21/00573/FUL


Observations:

I refer to your consultation dated 28th July 2023 regarding the above planning application for the removal of condition 9 ' ancillary of incidental use of planning decision 21/00573/FUL.

The original application proposed construction of three garages/stores , which was considered at the time to be a replacement for previous storage facilities. Although the Highway Authority noted, within the consultation response, that it was considered that the proposed use would be ancillary to existing operations of the current businesses, the condition to restrict as such was not requested.

Within this current application the applicant has included some justification to the removal of the condition within a covering letter. The current operator is reducing their level of operations from the premises and propose to sub-let the garages to other small businesses who may require storage provision. This is unlikely to give rise to a high demand of trips and potentially very similar levels to the current/ former use since permission was first approved.
The removal of the condition, taking into account the existing access and parking arrangements, and the size of the garages being unlikely to generate high levels of traffic in their own right, is unlikely to give rise to any significant changes in traffic or parking demand, and certainly unlikely to be severe when making reference to the NPPF.

As such there are no objections to the removal of the condition.

Recommendation:

The Highway Authority has no objection to the removal of condition 9 of planning permission 21/00573/FUL.
