My only concern would be their decision to move the extension's entrance from the Sawrey Street / Martin Street corner, where it was very legible and had a positive relationship with the street, to the more obscure position now proposed, tucked away in the undercroft space. I would be more concerned if the undercroft space was open to the public, rather than in a secure school site, but it's a shame the entrance's relationship with the street has been lost.

The proposal seeks to vary Condition 1 (Approved Plans) of application 22/01170/FUL to increase the footprint of the extension to Millbay Academy, relocate the entrance and vehicle exit alongside other associated works. The Highway Authority would not wish to raise any in-principle objections to the proposed development.

The submitted Design and Access Statement informs that the new proposed extension would obstruct the existing vehicle egress point and therefore a new exit is proposed further west along the drop-off point.

As identified within pre-application advice from the LHA, the off-street drop off area was a necessary component when determining the original planning application for the school and therefore its retention was paramount as part of any re-development. Whilst this variation would reduce the size of the drop-off area, it remains functional and as such, the LHA would not wish to raise any in-principle objections to the relocation of the egress point. Additional consent will need to be sought from Network Management to facilitate the provision of a new commercial vehicle crossing.

Any proposed access gates are not permitted to open outwards onto the public highway. Therefore, the gates serving the new egress should be of a type which do not protrude over the public highway on Sawrey Street when in operation.

The vehicle crossing serving the existing exit will become redundant following the proposed development. As such, there will be the requirement to remove the vehicle crossing and reinstate the kerb line and footway, ensuring the materials used match those as existing on Sawrey Street. Such works can be carried out under a permit obtainable from Network Management.

In conclusion, the LHA would not wish to make any in-principle objections to the proposed variation of conditions and would recommend the following conditions be attached with any grant of consent:

Planning conditions:
ACCESS GATE TYPE (ADJACENT TO HIGHWAY)
The gates to the access hereby permitted shall be of a type that does not project over the adjacent public highway when open or being opened.

Reason:
To ensure that the gates do not project over the adjacent highway at any time in the interest of public safety in accordance with Policy DEV29 of the Plymouth and South West Devon JLP 2019.

REINSTATEMENT OF FOOTWAY
The building shall not be brought into use until the existing footway crossing (to become redundant) has been removed and the footway reinstated in materials matching those as existing on Sawrey Street.

Reason:
In the interests of public safety, convenience and amenity in accordance with Policy DEV29 of the Plymouth and South West Devon JLP 2019.

INFORMATIVE: COMMERCIAL VEHICLE CROSSING
The applicant should contact the Highway Authority to facilitate the works in the highway by way of a licence and fees in accordance with this authority's procedure for the construction of a Commercial Vehicle Crossing.

INFORMATIVE: PUBLIC HIGHWAY APPROVAL
This planning permission does not authorise the applicant to carry out works within the publicly maintained highway. The applicant should contact Plymouth Highways for the necessary approval. Precise details of all works within the public highway must be agreed with the Highway Authority and an appropriate Permit must be obtained before works commence.



The proposed development has been considered in accordance with the Councils current Development Plan Policies and having regard for the National Planning Policy Framework.
