COMMENTS:
The Local Highway Authority (LHA) would not wish to raise any objections in principle to the proposed Change of Use from a retail unit (Class E) to the proposed specific use as 'a gym for use of residents of the student accommodation' in Use Class Sui Generis.
To protect highway safety and the free flow of traffic along Notte St/The Crescent, which is an arterial route around the city, from such things as hap-hazard, overspill parking, picking-up & dropping-off, loading and unloading, occurring there. The LHA would recommend that should planning permission be granted the lawful planning use of the application site 'Unit 4, Block B, Crescent Point, be restricted to the specific use proposed as 'a gym for use of residents of the student accommodation' only. With no other use permitted without first obtaining prior approval in writing from the LPA.
SUMMARY:
The Local Highway Authority (LHA) would not wish to raise any objections in principle to the proposed change of use from that of a retail unit, to a gym for use by student occupiers only. Should planning permission be granted then to protect highway safety and the free flow of traffic along the arterial route of Notte St/The Crescent, it is recommended that the following restrictive condition or a variation thereof be included in any grant of planning permission: -
RESTRICTIONS ON PERMITTED DEVELOPMENT
() Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (Amendment) (No.2) (England) Order 2008 (or any order revoking and re-enacting that Order or the 1995 Order with or without modification), no development falling within Classes 'E' and 'Sui Generis' of Part 1 of the Schedule to that Order shall be carried out, other that the use herby approved as 'a gym for use of residents of the student accommodation' only.
Reason:
In order to protect highway safety and the free flow of traffic along the arterial route of Notte St/The Crescent, in accordance with Policy DEV29 of the adopted Plymouth & Southwest Devon Joint Local Plan 2014 - 2034.
