In terms of our consultation response regarding planning application 24/01033/FUL, the Local Highway Authority (LHA) has checked the extra information in terms of the vehicle tracking assessment and finds the tracking information acceptable.In terms of the newly constructed wall, and surfacing works on the highway in Dawes Lane, comments have been received from the City Council Street Services team who have checked their applications for work on the highway and suggest the relevant permissions / licenses have not been received for the work.
In terms of the wall, the Street Services (Structures) team advise that because the wall is a structure that effects the public highway, an Approval in Principle (AIP) form is required and they have checked and this has not been received. An AIP is standard for each such structure affecting the public highway.
It should be noted that, in terms of the wall, as advised by the Planning Enforcement Team if the AIP is provided and approved this would be permitted development and not subject to planning control. If this retaining wall is considered unacceptable, then there is an overlap between planning control and highways control. The LHA would therefore advise an AIP to be provided accordingly in order that the matter can progress forwards.
