Thank you for consulting Historic Environment about the above condition discharge application. The conditions from application 23/01693/FUL relate to the grade II listed 33 Southside Street. Of the conditions seeking discharge only condition 6. External Seating Area is relevant to Historic Environment, as such our comments for condition 6 are below and we will defer to other consultees for Conditions 4,5 and 7.This information submitted to satisfy condition 6 appear to be insufficient to discharge the condition. The condition specifically asks for details on how the seating will be stored, the materials proposed and details on how the seating area will be managed. This information does not appear to have been submitted, only a brief description in the Condition Discharge Statement and an unannotated drawing. We can assume from the Proposed External Seating Plan and Elevations Drawing that the benches will be timber with two umbrellas above and a glazed barrier that is not fixed to the cobbles surrounding three sides. However these materials is not explicitly stated or confirmed in writing or via annotated on the drawings. We also note that there appears to be a contradiction between the elevations and site plan drawing. The elevations show two hexagonal umbrellas but the site plan shows a large rectangular canopy over area. This is presumably an unintentional contradiction, but details to clarify, including the proposed canopy would be required to satisfy condition 6.
Condition 6 -
The new restaurant area shall not be used until details of the proposed external seating area have been submitted to and approved in writing by the Local Planning Authority. The details shall include the number of tables and chairs proposed, how they will be stored, what materials hey will be and a written scheme on how the area will be managed which will include prevention/ control of flying pests and litter. The works shall conform to the approved details and the area shall be managed in accordance with the approved details thereafter.

Condition 5 ' Deliveries and Servicing:The applicant has submitted a plan to support the discharge of the servicing condition attached to application 23/01693/FUL. The plan highlights the areas to be used for servicing purposes, including an area adjacent to the restaurant which is understood to have been utilised for servicing in the past, alongside 4x pay and display parking bays on the southern side of Southside Street.
Further information regarding servicing provision will be required before the Local Highway Authority (LHA) are able to recommend the application for discharge. The private area highlighted for servicing purposes on the submitted details is also proposed to be used to site the external seating area. Clarification will need to be provided with regard to how this area will be managed to ensure that servicing can continue to be accommodated off the public highway in line with previous comments from the LHA.
In view of the above, the LHA would seek for a management plan relating to servicing and deliveries to be provided for review in accordance with the requirements of condition 5 before the condition can be recommended for discharge.
The proposed development has been considered in accordance with the Councils current Development Plan Policies and having regard for the National Planning Policy Framework.
