The proposals seek a partial change of use of land to domestic curtilage, the erection of a garage and associated access/landscaping (part retrospective). The Local Highway Authority (LHA) would not wish to raise any in-principle objections to the proposed development subject to further details.

A new vehicular access will be created off Hartley Road which is currently private and therefore, there is no requirement for additional approval from Network Management to facilitate the new vehicle crossing.

Whilst the proposed double garage does not meet the minimum length required in the SPD (6.5m), there is sufficient space within the hardstand to accommodate the parking demand associated with the site.

The Proposed Site Layout indicates the provision of a planting bed adjacent to the proposed vehicle crossover where there is currently a grass verge.

Whilst there is a notional footway (defined by white lining) along the northern side of Hartley Road to provide a route for pedestrians, on-street parking often takes place which obstructs the use of this route. The grass verge provides an additional level of defensible space for pedestrians especially when needing to move off the carriageway to clear the way for passing vehicles. Therefore, the LHA would recommend that further details are provided by way of an amended Proposed Site Layout which shows the omission of this planting bed in order to maintain the existing levels of defensible space for pedestrians in the interests of highway safety.

In addition, a Provision of Sight Lines condition should also be attached to any grant of consent to ensure that adequate inter-visibility is provided at the new vehicular access. The details should ensure that any boundary treatment within the visibility splay does not exceed 900mm in height.

No development shall take place until an amended Proposed Site Layout drawing has been provided which details the removal of the planting bed currently shown on drawing 0102-Rev C so that adequate levels of defensible space are maintained for pedestrians.

Reason:
To ensure that these further details are acceptable to the Local Planning Authority and that they are in keeping with

SURFACING OF DRIVEWAY/PARKING AREAS
Before the development hereby permitted is occupied, the driveway and parking area shall either be (a) constructed using a permeable construction or (b) hard paved for a distance of not less than 1m from the edge of the highway and drained to a private soakaway; and shall thereafter be maintained to ensure satisfactory access to the adjoining highway, in accordance with details to be submitted to and approved in writing by the Local Planning Authority.

Reason:
To ensure that no private surface water or loose material is deposited onto the adjoining highway in the interests of highway safety in accordance with Policy DEV29 of the Plymouth and South West Devon JLP 2019.

PROVISION OF SIGHT LINES
No development shall take place until details of the sight lines to be provided at the junction between the means of access and the highway have been submitted to and approved in writing by the Local Planning Authority. The approved sight lines shall be provided before the vehicular access is first brought into use.

Reason:
To provide adequate visibility for drivers of vehicles at the road junction in the interests of public safety in accordance with Policy DEV29 of the Plymouth and South West Devon JLP 2019.





The proposed development has been considered in accordance with the Councils current Development Plan Policies and having regard for the National Planning Policy Framework.
