APPLICATION SUMMARY

COMMENTS:
The Local Highway Authority (LHA) would not wish to raise any objections in principle to the proposed variation of Condition 3 (Specified Use Restriction) of application 22/00518/FUL, to allow Unit 10 to operate within Class E(d) for indoor sport and recreation activities.

The associated covering letter informs that consent 22/00518/FUL already expressly permits the use of Unit 21 as Class E(d) for indoor sport and recreation; and considers, the proposed variation of Condition 3 would therefore not introduce a new use that has not already been fully assessed and considered to be acceptable. Also, in that Unit 10 is limited to 21.1sqm of internal floorspace and the impacts associated with the proposed use are therefore limited in matters such as accessibility and the character of the site.

Therefore, the LHA would reiterate the previous associated comments and recommendations of the reply dated 14th April 2022: -

The proposed use by Eat Work Art would include their head office function, along with twenty-three studio spaces for use by third parties. Paragraphs 7.14- 7.20 of the application Planning and Heritage Statement considers (inter-alia) Sustainability of the site, and Transport impacts. The LHA considers the associated transport and highway impacts from the partial Change of Use, are likely to be similar to that of the previous use. To further encourage sustainable travel options, it is recommended that a light touch Travel Plan is implemented.

The application details indicate the arrangements for both pedestrian, vehicle access, and parking, would remain unchanged and as existing. The two off-street car parking spaces situated along the frontage of the building would be retained, and it is recommended in accordance with Council policy that one in number Electric Vehicle car charging point is provided. Along with the eighteen in number proposed cycle parking spaces that would be provided, apparently with scope for that number to be increased if needed

The application site is situated within a Permit Parking Zone where on-street parking restrictions apply, and the application site would be excluded from entitlement to on-street parking permits. Outside of the application site, along the north side of Sawrey Street, there is short-stay on-street car parking that is limited to up to one hour duration (with no return for 3hrs), that operates between the times of 08:00hrs & 18:30hrs Monday to Saturday.

SUMMARY:
The LHA would not wish to raise any objections in principal to the proposed Change of Use recommending the following planning conditions are included in any planning consent:-

PROVISION OF ELECTRIC VEHICLE CHARGING POINT
() To assist lower carbon emissions one in number Electric Vehicle Charging Point shall be provided in accordance with the details set-out in par 8.39 & Table 33 of the Councils Supplementary Planning Document (SPD).

Reason:
To assist in the lowering the carbon footprint of the development in accordance with Policy DEV29 of the adopted Plymouth & Southwest Devon Joint Local Plan 2014 ' 2034


CYCLE PROVISION
() The building shall not be occupied until space has been laid out within the site in accordance with the guidance contained within Councils Supplementary Planning Document (SPD) for the proposed eighteen (18) in number bicycles to be securely parked. The secure area for storing bicycles shall remain available for its intended purpose and shall not be used for any other purpose without the prior consent of the Local Planning Authority.

Reason:
In order to promote cycling as an alternative to the use of private cars in accordance with Policy DEV29 of the Plymouth and South West Devon JLP 2019.


PROVISION OF PARKING AREA
() The two existing off-street car parking spaces situated at and along the front of the building shall be retained for associated car parking and made available for use at all times before the building that it serves is first occupied and thereafter that space shall not be used for any purpose other than parking of cars.

Reason:
To enable vehicles used by occupiers or visitors to be parked off the public highway so as to avoid damage to amenity and interference with the free flow of traffic on the highway in accordance with Policy DEV29 of the Plymouth and South West Devon JLP 2019.


TRAVEL PLAN
() The use hereby permitted shall not commence until a (Light-touch) draft Travel Plan has been submitted to and approved in writing by the Local Planning Authority. The said Travel Plan shall seek to encourage staff and all site users to use modes of transport other than the private car to get to and from the premises. It shall also include measures to control the use of the permitted car parking areas; arrangements for monitoring the use of provisions available through the operation of the Travel Plan; and the name, position and contact telephone number of the person responsible for its implementation. From the date of the commencement of the use the occupier shall operate the approved Travel Plan.

Reason:
The Local Planning Authority considers that such measures need to be taken in order to reduce reliance on the use of private cars (particularly single occupancy journeys) and to assist in the promotion of more sustainable travel choices in accordance with Policy DEV29 of the Plymouth and South West Devon JLP 2019. The applicant should contact Plymouth Transport and Infrastructure for site-specific advice prior to preparing the Travel Plan.


INFORMATIVE: RESIDENT PARKING PERMIT SCHEME
() The applicant should be made aware that the application property lies within a parking permit scheme and shall be excluded from obtaining permits and purchasing visitor tickets for use within the scheme.
