Generally speaking where an application is seeking to change the use of a site away from an economic function to residential we would seek supporting evidence that demonstrates the current use is unviable. Policy Dev 14 states: 'Change of use of existing employment sites (including vacant sites whose lawful use is for employment purposes) will only be allowed where the following applies:

i. The proposal is specifically provided for by the local plan to deliver wider strategic objectives, or

ii. There are overriding and demonstrable economic, regeneration and sustainable neighbourhood / communities benefits from doing so, or

iii. There is no reasonable prospect of a site being used for employment use in the future,'.

If the application is taken to a full app stage we would expect to receive supporting information to justify the loss of the employment site.

Highway Authority

This pre-application enquiry seeks advice on the proposed change of use from public house (Sui Generis) to 2x dwellings (Class C3). The Local Highway Authority (LHA) would not wish to raise any in-principle objections to the proposed development.

The proposals seek to convert the existing pub to provide 2x, 2-bed dwellings. When considering the indicative parking demand as detailed within the SPD, the proposed development would need to be served with 4x off-street parking spaces; 2x per dwelling.

However, the property as existing is not benefited with any off-street parking provision and this is to remain the case as part of the proposed development.

The site is located within a relatively accessible and sustainable location of the city and is a short walk away from the amenities and bus stops along Union Street. The city centre is also within an acceptable walking distance of the site which provides public transport connections to the rest of the city. In addition, a Controlled Parking Zone (CPZ) is in operation within the surrounding streets between the hours of 11am to 3pm, Monday to Sunday. The on-street parking bays to the front of and adjacent to the site are subject to these parking controls. It should be noted that the development is likely to be excluded from obtaining permits and visitor tickets for use within this CPZ if future planning permission were to be granted.

Whilst overspill parking could occur outside of the hours whereby the CPZ is enforced, it is important to note that the peak operational times associated with the existing use as a pub would have taken place during peak residential parking times. Whilst the exact parking demand associated with the existing use is unable to be quantified due to the limited level of information provided, due to the lack of available off-street parking at the site, it is reasonable to accept that the pub would have generated a level of overspill parking within the surrounding area, especially into the evening.

Therefore, it is not considered that the proposed development would give rise to any additional traffic and transport impacts over and above those previously established as part of the former use. For this reason, the LHA would not wish to raise any in-principle objections to the proposed development.

Secure and covered cycle storage will be required in accordance with the levels and standards as set out within section 8 of the SPD.


The proposed development has been considered in accordance with the Councils current Development Plan Policies and having regard for the National Planning Policy Framework.
