COMMENTS:
The Local Highway Authority (LHA) would not wish to raise any objections in principle to the resubmission of the proposed development for the 'extension to offices for vehicle rental premises, and the removal of existing/erection of new wash bay, (previously refused under application number 24/01525/FUL) with amended plans showing the previously approved in principle site access.
A new site access from Lister Close was granted in principle under application 23/01472/Ful. Although it is accepted the planning consent would not allow access across the private grass verge that is outside the site boundary, or across the public footway. Where to create a new commercial vehicle junction type entrance into the site, the applicant would need to acquire the right of access from the Council as a private landlord, along with a permit from the Council Highways team for and to agree the alterations to safely accommodate the new access in the public highway.
The LHA previously requested a drawing showing a cross section through the new access junction to show the changes to ground levels, with cross sections often including construction details. However, instead the application drawing titled and numbered General Arrangement Site Layout - 2327.B-015 REV D, shows spot levels of 14.66 at the site boundary of the new access, and 14.70 at the carriage way channel in Lister Close. Indicating that cross falls would be satisfactory, surface water would not issue out of the site and onto the public street, and appropriate surface levels would be achieved. Incidentally, the LHA has seen associated drawing that is not part of the application details that further confirms the levels and crossfalls would be satisfactory. The associated drawing titled Proposed Entrance Layout Levels, that includes a line drawing section showing existing and proposed road levels, was submitted to the Councils estates team and is not part of the application details. The new site access in the form of a commercial vehicle crossing junction shall be constructed in accordance with the Councils specifications for a Commercial Vehicle Crossings.
Cycle parking shall be provided in accordance with the Councils standards set out in the Supplementary Planning Document (SPD): - (par 8.29) All cycle parking incorporated into new developments should meet the following criteria: secure; convenient; clearly visible; well signed; well lit; easily accessible; step free and preferably covered in accordance with the minimum standards below. Any deviation from these criteria and standards must be explicitly justified. (par8.30) High quality and conveniently located, secure cycle parking should be incorporated into new developments in accordance with the minimum standards below: (Table 32) showing the minimum cycle parking as being 25 per cent of the indicative car parking provision or 1 space per 8 employees, whichever is greater.
Car parking and electric vehicle charging points shall be provided in accordance with the submitted application layout drawing titled and numbered General Arrangement Site Layout - 2327.B-015 REV D.
SUMMARY:
The Local Highway Authority (LHA) would not wish to raise any objections in principle to this resubmission of the proposed development, which includes a new site access from Lister Close previously consented in principle under application 23/01472/Ful, subject to the above comments and with the following planning conditions being applied.
PROVISION OF PARKING AREA
() Each parking space shown on the approved plans shall be constructed, drained, surfaced and made available for use along with the Electric Vehicle Charging Points as shown before the unit of accommodation that it serves is first occupied and thereafter that space shall not be used for any purpose other than the parking of vehicles. Reason:
To enable vehicles used by occupiers or visitors to be parked off the public highway so as to avoid damage to amenity and interference with the free flow of traffic on the highway in accordance with Policy DEV29 of the adopted Plymouth & Southwest Devon Joint Local Plan 2014 - 2034.
CYCLE PROVISION (amended)
() The new site layout and access shall not be brought into use until space has been laid out within the site for cycle parking/storage in accordance with the guidance set-out in paragraph 8.30 of the Councils SPD. To provide high quality conveniently located, secure, and preferably covered cycle parking/storage at a minimum ratio of 25 per cent of the car parking provision or 1 space per 8 employees, whichever is greater. The secure area for storing bicycles shown on the approved plan shall remain available for its intended purpose and shall not be used for any other purpose without the prior consent of the Local Planning Authority.
Reason:
In order to promote cycling as an alternative to the use of private cars in accordance with Policy DEV29 of the adopted Plymouth & Southwest Devon Joint Local Plan 2014 - 2034.
THE NEW VEHICLE ACCESS JUNCTION (Commercial Vehicle Crossing)
The new vehicle access junction between the car park and the road carriageway in Lister Close previously granted in principal shall be constructed in accordance with the Councils, Plymouth Highways, approved details specifications and materials for the construction of a new Commercial Vehicle Crossing. The new vehicle access shall not be brought into use until the junction has been constructed in accordance with those details.
Reason:
To ensure that an appropriate and safe access is provided in the interests of public safety, convenience and amenity in accordance with Policy DEV29 of the adopted Plymouth & Southwest Devon Joint Local Plan 2014 - 2034.
IN14 INFORMATIVE: PUBLIC HIGHWAY APPROVAL
() This planning permission that includes a new vehicle access/egress in the form of a Commercial Vehicle Entrance/Exit junction arrangement in Lister Close (and the previous permission granted under application number 23/01472/FUL) does not authorise the applicant to carry out works within the publicly maintained highway. The applicant should contact Plymouth Highways as the Local Highway Authority to agree the precise details of the construction works and for the necessary further approval, along with obtaining an appropriate Permit before work commences.
