Following an assessment of the proposed development at 42 Station Road, I can confirm the application makes reasonable provision for on-site bin storage and provides accessible arrangements for residents. However, please note the following operational requirements and legislative considerations regarding waste containment and presentation:Bin Presentation & Collection Requirements:
All containers will need to be presented at the kerbside on the scheduled day of collection and returned within the boundary of the property once emptied. This is in accordance with Section 46(1) of the Environmental Protection Act 1990, which sets out the legal expectations for the storage and presentation of household waste. Residents must ensure bins are not left on the public highway outside of collection windows.
Failure to comply with this may result in enforcement action. Where bins are persistently left on the footpath, they may be removed, particularly if they are deemed a hazard under the following conditions:
' Excessive quantity obstructing the public footway
' Narrow width of the pavement preventing safe access for pedestrians, including wheelchair and pram users
' Gradient of the area increasing the risk of bins tipping or obstructing movement
If such risks materialise, alternative arrangements for waste storage or collection will need to be considered in consultation with resident/landlord.
Expectations for Waste Management in HMOs or Multi-Occupancy Dwellings
The following best practices are expected for properties comprising self-contained flats or Houses in Multiple Occupation (HMOs):
' Provision of sufficient PCC-issued bins, calculated based on the number of occupants
' All bins should be clearly labelled with the property address or flat number to prevent confusion or misuse
' Waste collection information (e.g., collection days, recycling guidance) must be displayed within the property in a common area
' Waste responsibilities should be embedded within the tenancy agreement to establish clear expectations with residents from the outset
These measures ensure both compliance with statutory duties and the ongoing cleanliness and safety of public spaces in residential communities.
Should the application proceed to the full planning stage, we recommend including a Waste Management Statement outlining how the above requirements will be met in practice.
NOTICE UNDER SECTION 46 (1) OF THE ENVIRONMENTAL PROTECTION ACT 1990
To: The Occupier(s)
This notice requires you as the occupier to:
A Place only household waste for collection from the property inside the allocated Plymouth City Council container
B Place appropriate contents in the correct container for recycling, non-recycling or garden waste C Comply with the requirements in the schedule below.
SCHEDULE
1. The green, brown or grey containers provided to you by the Council, must be:
a. Placed at the usual kerbside place of collection no earlier than 6.30pm the night before your collection day, or no later than 6.30am on the day of collection.
b. Returned to their usual storage location off any public pavements and roads before midnight on the day of your collection.
c. Your collection day can be checked online at www.plymouth.gov.uk/checkyourbinday
2 Your green recycling container must only contain:
a. Loose recyclable materials
b. The following recyclable material:
o Newspapers/Magazines/junk mail/printer paper/envelopes
o Cardboard boxes/cardboard packaging (e.g. cereal boxes), greeting cards
o Phone directories, catalogues and yellow pages
o Rinsed plastic bottles, yogurt pots and margarine tubs.
o Rinsed food and drink cans
o Rinsed aluminium foil containers
o Empty aerosol cans with lids removed
o Rinsed glass bottles and jars
3. Your brown container must only be used for household waste that cannot be recycled.
4 Your grey container must only contain the following garden waste:
o Grass cuttings, flower, hedge and shrub trimmings
o Leaf and plant matter such as weeds
o Sticks and twigs up to 7cm in width
5. Your containers are for household waste only.
6. You must NOT place any additional bags or waste next to or on the containers. Excess waste not within containers like this will be considered to be littering or fly tipping.
7. Any item which is too large to fit into the containers allocated to the property must be either taken to a recycling centre or collected by a registered waste carrier.
8. Any excess or bulky waste items must be stored on your property until the day of removal by yourself or collection by a registered waste carrier.
